1. Acceptance of Terms

By accessing or using OmniScribe ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. Description of Service

OmniScribe is a desktop speech-to-text application that converts voice input into text in any application. The Service includes a desktop application (Linux, macOS, Windows), a web dashboard for account management, and subscription-based access to premium features.

3. Accounts

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials. You must provide accurate and complete information during registration. You may not share your account or license with others except as permitted under your subscription tier.

4. Subscriptions & Payments

OmniScribe offers Free, Pro, and Enterprise subscription tiers. Paid subscriptions are billed in advance on a monthly or annual basis and automatically renew unless canceled.

Payments are processed by Dodo Payments, our Merchant of Record. By subscribing, you agree to Dodo Payments' terms and conditions. All prices are listed in USD and include applicable taxes where required by law.

You may cancel your subscription at any time through the billing portal. Cancellation takes effect at the end of the current billing period. You will retain access to paid features until that date.

5. Refund Policy

We offer a 7-day refund window from the date of initial subscription purchase. To request a refund, contact us at omniscribe@bspmme.anonaddy.com. Refunds are not available for renewal payments or after the 7-day window. Refunds for annual subscriptions are prorated at our discretion.

6. Free Tier

The Free tier is provided at no cost with limited features and a word usage cap of 2,000 words per 5-hour window. Free tier usage requires an active internet connection. We reserve the right to modify or discontinue the Free tier with reasonable notice.

7. License Grant

Subject to your compliance with these Terms and payment of applicable fees, OmniScribe grants you a limited, non-exclusive, non-transferable, revocable license to install and use the OmniScribe desktop application on devices you own or control, solely for your personal or internal business purposes.

8. Restrictions

You may not:

• Reverse engineer, decompile, or disassemble the software
• Modify, adapt, or create derivative works
• Remove or alter any proprietary notices
• Use the Service for any unlawful purpose
• Attempt to bypass license verification or usage limits
• Resell, lease, or sublicense the Service without written permission

9. Intellectual Property

OmniScribe and all related software, branding, and content are owned by OmniScribe and protected by copyright, trademark, and other intellectual property laws. These Terms do not grant you any ownership rights in the Service.

10. Privacy

Your use of the Service is governed by our Privacy Policy. By using the Service, you consent to the collection and processing of data as described therein.

11. Limitation of Liability

To the maximum extent permitted by law, OmniScribe shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability is limited to the amount you paid us in the 12 months preceding the claim.

The Service is provided "as is" without warranty of any kind, express or implied. We do not guarantee uninterrupted or error-free operation.

12. Termination

We may suspend or terminate your account for violation of these Terms. Upon termination, your license to use the Service ends immediately. You may terminate your account at any time by contacting us. Data retention after termination is governed by our Privacy Policy.

13. Governing Law & Jurisdiction

These Terms are governed by the laws of India. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Bangalore, Karnataka, India.

14. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or through the Service. Continued use after changes constitutes acceptance.
